APT Locator – Full Rebate & Referral Terms & Conditions

This document outlines the official terms and conditions (“Terms”) governing the rebate and referral programs offered by APT Locator (“we,” “our,” or “us”), a licensed real estate brokerage operating in compliance with the Texas Real Estate Commission (TREC). By using our services, submitting a form, referring a client, or leasing through APT Locator, you (“Client,” “User,” or “Referrer”) agree to all terms stated herein.


1. Purpose of Program

APT Locator offers eligible clients the opportunity to receive a rebate after leasing through our service and referring us properly, as well as the opportunity for others to receive a small-value gift in appreciation for qualified referrals. These programs are strictly voluntary, not guaranteed, and subject to change without notice.


2. Rebate Program Overview

A “rebate” refers to a portion of the locator commission we receive from a participating apartment complex that is returned to the principal (the lessee) as a thank-you for using APT Locator’s services. This is only applicable to the actual lessee involved in the transaction.

  • Rebates are not commissions paid to unlicensed individuals.

  • Rebates are not given in exchange for a referral.

  • Rebates are discretionary and subject to commission receipt from the apartment complex.


3. Referral Gift Program Overview

A “referral gift” is a non-cash token of appreciation (not exceeding $50 retail value) that may be given to unlicensed individuals who refer a new client who successfully leases through APT Locator.

  • The referrering individual must submit their referral form listing the referring party prior to lease signing.

  • The referring party must not be a licensed real estate agent or a party to the transaction.

  • Referral gifts are not payments and do not constitute consideration.


4. Eligibility Requirements for Rebates

To qualify for a rebate, all the following conditions must be met:

  1. Proper Registration: The client must list “APT Locator” as the referral source on both the guest card and the rental application at the time of first contact with the property.

  2. Timely Form Submission: The client must submit the official rebate form via aptlocator.com/referral within 90 calendar days of the official move-in date. Submissions beyond this window are subject to denial.

  3. Form Accuracy: All information must be complete and verifiable, including legal name, community name, lease term, move-in date, and valid mailing address.

  4. Apartment Eligibility: The leased property must participate in the locator referral program and issue commission payments to APT Locator.

  5. Payment Receipt: We must receive full commission payment from the property in order to process the rebate. If no commission is paid, no rebate will be issued.


5. Ineligibility Scenarios

You will not qualify for a rebate if:

  • You fail to submit the form within 90 days of move-in.

  • You do not list APT Locator on the guest card and/or application.

  • The property does not pay APT Locator a commission.

  • The lease is canceled, forfeited, terminated early, or not honored by the client.

  • You provide incomplete, incorrect, or fraudulent information on the rebate form.

APT Locator reserves the right to deny rebate or referral payments without obligation to provide further explanation.


6. Processing Timeline

Rebate and referral payments are typically processed within 30 to 90 days following your official move-in date and successful commission payment. Delays may occur due to:

  • Payment delays from the apartment complex.

  • Missing or inaccurate information in your form.

  • Commission disputes or invoice rejections from the property.

  • Periods of high volume or system backlog.

We appreciate your patience during this process and encourage you to contact us with questions before assuming your payment is lost or withheld.


7. Payment Method & Delivery

All rebates and referral gifts are paid by mailed check only. No digital payments (e.g., Zelle, Venmo, PayPal, or Cash App) will be offered under any circumstance.

  • Checks will be mailed to the address submitted on your form.

  • Please allow 7–14 business days after processing for delivery.

  • Lost, returned, or expired checks may be subject to reissue fees or disqualification.

It is the client’s sole responsibility to ensure their mailing address is correct. APT Locator is not liable for lost or delayed mail due to incorrect information.

Under unique circumstances, alternative rebate methods may be considered solely at the discretion of APT Locator. Approval of any non-check disbursement is not guaranteed and is determined on a case-by-case basis, at our convenience, and without obligation.


8. Expiration of Payment

All rebate and referral checks must be cashed or deposited within 180 days of the issuance date. After this period, the check will be voided and the payment considered forfeited. No reissue or replacement will be provided after expiration.


9. Referral Gift Compliance (TREC)

Per TREC Rule 535.20(a):

  • License holders may not pay an unlicensed person any form of consideration for referring a potential buyer or tenant.

  • However, non-cash gifts of up to $50 in value that are redeemable for merchandise (such as gift cards to restaurants or retailers) are permitted.

  • Visa, Mastercard, or prepaid debit cards that can be converted to cash are not permitted.

  • Gifts must not be advertised as compensation or inducement to refer business.

APT Locator complies fully with these guidelines and issues gift cards for merchandise only.


10. Rebates vs. Gifts – Legal Distinction

  • Rebates are paid to the actual party to the lease transaction and may be any amount permitted by law, so long as we are compensated and lender consent is not violated.

  • Referral gifts are capped at $50, are not tied to any formal agreement, and are given as a courtesy, not compensation.


11. Contests, Giveaways, and Promotions

Any public promotion or giveaway offered by APT Locator will adhere to the Texas Penal Code:

  • Promotions will not involve mandatory referrals, purchases, or social media engagement as a condition for entry when prize value exceeds $50.

  • Giveaways will never qualify as an illegal lottery under Texas law.

  • Contests open to the public will include official rules, terms, and eligibility disclosures.


12. Client Thank-You Gifts

APT Locator may provide a gift of gratitude to clients who use our brokerage to lease a property, separate from any rebate. These may exceed $50 in value and are not tied to any referral or promotional condition.

Examples include:

  • Restaurant or move-in themed gift cards

  • Branded welcome kits

  • Limited-time thank-you packages

These gifts are offered at our sole discretion and are not promised or negotiated as part of your lease.


13. Duplicate or Conflicting Claims

Only one referral gift will be issued per referred client. If multiple individuals claim to have referred the same person, APT Locator will determine, at its sole discretion, whether to issue any payment and to whom. In some cases, all claims may be denied.


14. Limitation of Liability

APT Locator is not responsible for:

  • Failure of the apartment complex to pay commissions

  • Delays or errors caused by mail carriers

  • Client failure to follow instructions or submit accurate forms

  • Payment delays caused by fraud review or compliance protocols

By participating, you agree to hold harmless APT Locator, its agents, employees, and affiliates from any liability related to the rebate or referral process.


15. Final Determination & Dispute Resolution

All eligibility decisions are final. APT Locator reserves the right to:

  • Deny any rebate or referral gift for failure to comply with these terms

  • Withhold payment in the event of fraudulent or misleading information

  • Update or terminate these programs at any time without notice

We do not accept appeals, challenges, or exceptions once a determination has been made.

By using our services, submitting a form, or participating in our rebate or referral programs, you acknowledge that:

  • You have read, understood, and agree to these Terms in full.

  • You are not relying on any oral promise or informal communication to receive payment.

  • You are solely responsible for ensuring your eligibility and compliance.

APT Locator reserves the right to modify these Terms at any time, with or without notice. The most current version will always be posted at aptlocator.com/referral and is binding on all participants.
